Terms of Service for Motivu
Last updated: 31 October 2026
These Terms of Service ("Terms") govern your use of the Motivu app ("Motivu", "the app", "we", "us", or "our"), operated by Gian Seymour Moral, an individual developer based in New Zealand. By downloading, accessing, or using Motivu, you agree to these Terms. If you do not agree, do not use the app.

1. Who can use Motivu
You must be at least 13 years old to use Motivu. By using the app, you confirm that you are 13 or older. Motivu is not intended for children under 13.
2. Health and fitness disclaimer — please read carefully
Motivu is a fitness and nutrition tracking tool. It is not a medical device and does not provide medical advice.
- The calorie, protein, fibre, and other targets Motivu calculates are general estimates based on standard formulas (such as the Mifflin-St Jeor equation) and the information you enter. They are not personalised medical or dietary advice and may not be appropriate for you.
- Any "calories burned" or "net calories" figures are estimates only and may be inaccurate.
- Motivu does not know your medical history, conditions, medications, allergies, or individual circumstances.
- Always consult a qualified doctor, dietitian, or other healthcare professional before starting any new exercise or nutrition program, especially if you are pregnant, have a medical condition, an eating disorder or history of one, or any other health concern.
- Do not use Motivu as a substitute for professional medical advice, diagnosis, or treatment. Never disregard or delay seeking professional advice because of something in the app.
- You are solely responsible for your own health, training, and dietary decisions. You use Motivu at your own risk.
If you think you may have a medical emergency, contact a doctor or emergency services immediately.
3. Your account
If you create an account, you are responsible for keeping your login details secure and for all activity under your account. You agree to provide accurate information. Notify us at motivuapp@gmail.com if you believe your account has been compromised.
4. Subscriptions and payments
Motivu offers an optional paid subscription ("Motivu Pro") that unlocks additional features. Core features remain free.
- Billing: Subscriptions are offered on a monthly or annual basis. Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-renewal: Subscriptions automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours before the end of the current period, at the price shown at the time of purchase.
- Managing and cancelling: You can manage or cancel your subscription in your Apple ID account settings (Settings → your name → Subscriptions). Cancelling stops future renewals; it does not refund the current period.
- Free trials (if offered): If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
- Deleting your account does not cancel your subscription. You must cancel through Apple as described above.
- Prices are shown in the app and may vary by region. We may change prices in the future; any change will apply to future billing periods, not your current one.
All purchases are also subject to Apple's standard terms (the Apple Media Services Terms and Conditions / standard EULA).
5. Acceptable use
You agree not to:
- Use Motivu for any unlawful purpose;
- Attempt to interfere with, disrupt, reverse-engineer, or gain unauthorised access to the app or its systems;
- Use the app in any way that could harm Motivu, other users, or third-party service providers.
6. Your content and data
The workouts, food logs, and other information you enter belong to you and are stored on your device. You are responsible for backing up anything you want to keep; because this data is stored on your device, it may be lost if you uninstall the app, lose your device, or delete your account. The "Export my data" feature lets you save a copy.
7. Intellectual property
Motivu, including its name, logo, design, and software, is owned by us. You are granted a limited, personal, non-transferable licence to use the app for your own personal, non-commercial use. You may not copy, modify, distribute, or resell any part of the app.
Food and nutrition data is provided by Open Food Facts (under the Open Database License) and USDA FoodData Central, and remains subject to their respective terms.
8. Disclaimers and limitation of liability
- Motivu is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the app will be error-free, uninterrupted, or that any data or calculation is accurate.
- To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising from your use of (or inability to use) the app.
- To the fullest extent permitted by law, our total liability to you for any claim relating to the app is limited to the amount you paid us (if any) in the 12 months before the claim.
- Nothing in these Terms limits any rights you have under applicable consumer protection laws (including the New Zealand Consumer Guarantees Act, where it applies) that cannot be excluded.
9. Termination
We may suspend or terminate your access to Motivu if you breach these Terms. You may stop using the app at any time and delete your account from within the app.
10. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date. Continued use of the app after changes means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of New Zealand. Any disputes will be subject to the jurisdiction of the New Zealand courts, subject to any non-waivable rights you have under the laws of your own country of residence.
